Fairfax County police say the driver of a minivan that fatally struck a 9-year-old boy on an electric scooter Thursday was operating her vehicle safely and is not suspected of reckless driving.

Capt. Harold Morris, the department's assistant traffic division commander, announced the finding at a Friday press conference. No charges have been filed.

"There's no indication at this time that there's any unsafe or reckless manner in which the driver, an adult female, was operating this van," Morris said.

The crash happened around 5:30 p.m. Thursday in the 3000 block of Madden Court in Herndon's Highland Mews neighborhood, near Sully Square. The driver of a 2012 Honda Odyssey had just turned left from Highland Mews Court into a parking area when the boy's scooter struck the rear passenger side of the vehicle as it completed the turn, according to FCPD.

The child was transported to a hospital in life-threatening condition and was pronounced dead there. The driver remained at the scene.

Morris said the boy did not appear to be wearing a helmet. Investigators are still working to determine the scooter's classification, capabilities and speed at the time of the collision.

Helmet law took effect weeks before crash

The Fairfax County Board of Supervisors approved a requirement on June 23 that anyone under 15 wear a protective helmet while riding an electric scooter, e-bike or motorized skateboard on local roads. That law took effect July 1, just three weeks before the collision.

At the press conference, FCPD distributed materials reminding parents and riders about Virginia's laws governing e-scooters and other electric recreational vehicles.

Alcohol and speed do not appear to be factors in the crash, police said.

Investigation ongoing

FCPD's Crash Reconstruction Unit detectives are canvassing the Highland Mews neighborhood for surveillance video and additional witnesses. The department's victim services division, health and wellness division and chaplains responded to support both the boy's family and the driver's family.

At an evening briefing Thursday, Capt. Chris Cosgriff, FCPD's public affairs bureau commander, called it "a very tragic incident for everyone in this neighborhood and for everyone involved" and urged parents to ensure children know road safety rules.
